Applicable regulatory text

In accordance with Article R.211-12 of the Tourism Code, brochures and travel contracts offered by travel agents to their customers must include in extenso the following general conditions from Articles R.211-3 to R.211-11 of the Tourism Code.

In accordance with Articles L. 211-7 and L. 211-17 of the French Tourist Code, the provisions of Articles R. 211-3 to R. 211-11 of the French Tourist Code, the text of which is reproduced below, are not applicable to the reservation or sale of transport tickets not included in a tourist package.

The organiser’s brochure, estimate, proposal and programme constitute the prior information referred to in Article R.211-5 of the Tourism Code. Therefore, in the absence of provisions to the contrary on the front of this document, the characteristics, special conditions and prices of the trip as indicated in the brochure, the estimate and the organiser’s proposal will be contractual as soon as the registration form is signed.

In the absence of a brochure, estimate, programme and proposal, this document constitutes, before its signature by the buyer, the prior information referred to in Article R.211-5 of the Tourism Code. It will lapse for lack of signature within 24 hours of its issue. In the event of a transfer of the contract, the transferor and/or transferee shall be required to pay the resulting costs in advance. When these costs exceed the amounts posted in the point of sale and those mentioned in the contract documents, supporting documents will be provided.

Excerpt from the Tourism Code

Article R.211-3 :
Subject to the exclusions provided for in the third and fourth paragraphs of Article L. 211-7, any offer and sale of travel or accommodation services shall be subject to the submission of appropriate documents in accordance with the rules defined by this section. In the event of the sale of air tickets or regular line tickets not accompanied by services related to such transport, the seller shall issue to the buyer one or more transit tickets for the entire journey, issued by the carrier or under its responsibility. In the case of on-demand transport, the name and address of the carrier on whose behalf the tickets are issued must be indicated. Separate invoicing of the various elements of the same tourist package does not exempt the seller from the obligations imposed on him by the regulatory provisions of this section.

Article R.211-3-1 :
The exchange of pre-contractual information or the provision of contractual terms and conditions shall be made in writing. They may be carried out electronically under the conditions of validity and exercise provided for in Articles 1369-1 to 1369-11 of the Civil Code. The name or business name and address of the seller and the indication of his registration in the register provided for in Article L. 141-3 a or, where applicable, the name, address and indication of the registration of the federation or union mentioned in the second paragraph of Article R. 211-2 shall be mentioned.

Article R.211-4 :
Before concluding the contract, the seller must provide the consumer with information on prices, dates and other elements of the services provided during the trip or stay, such as:
1° The destination, means, characteristics and categories of transport used;
2° The type of accommodation, its location, its level of comfort and its main characteristics, its certification and its tourist classification corresponding to the regulations or customs of the host country;
3° The catering services offered;
4° The description of the itinerary in the case of a circuit;
5° Administrative and health formalities to be carried out by nationals or by nationals of another Member State of the European Union or of a State party to the Agreement on the European Economic Area in the event of, in particular, border crossings and the time limits for their completion;
6° Visits, excursions and other services included in the package or possibly available for an additional charge;
7° The minimum or maximum size of the group allowing the trip or stay to take place and, if the trip or stay is subject to a minimum number of participants, the deadline for informing the consumer in the event of cancellation of the trip or stay; this date may not be set at less than twenty-one days before departure;
8° The amount or percentage of the price to be paid as a deposit upon conclusion of the contract and the schedule for payment of the balance;
9° The modalities of price revision as provided for in the contract pursuant to Article
R. 211-8 ;
10° Cancellation conditions of a contractual nature;
11° The cancellation conditions defined in Articles R. 211-9, R. 211-10 and R. 211-11;
12° Information concerning the optional subscription of an insurance contract covering the consequences of certain cases of cancellation or an assistance contract covering certain specific risks, in particular repatriation costs in the event of accident or illness;
13° Where the contract includes air transport services, the information, for each flight section, provided for in Articles R. 211-15 to R. 211-18.

Article R.211-5 :
The prior information given to the consumer is binding on the seller, unless the seller has expressly reserved the right to modify certain elements of it. In this case, the seller must clearly indicate to what extent this modification may occur and on which elements.
In any event, changes to the prior information must be communicated to the consumer before the contract is concluded.

Article R.211-6 :
The contract concluded between the seller and the buyer must be in writing, drawn up in duplicate, one of which must be given to the buyer, and signed by both parties. Where the contract is concluded by electronic means, Articles 1369-1 to 1369-11 of the Civil Code shall apply. The contract must include the following clauses:
1° The name and address of the seller, his guarantor and his insurer as well as the name and address of the organiser;
2° The destination or destinations of the trip and, in the case of a split stay, the different periods and their dates;
3° The means, characteristics and categories of transport used, the dates and places of departure and return;
4° The type of accommodation, its location, its level of comfort and its main characteristics and its tourist classification in accordance with the regulations or customs of the host country;
5° The catering services offered;
6° The itinerary in the case of a circuit;
7° Visits, excursions or other services included in the total price of the trip or stay;
8° The total price of the services invoiced as well as the indication of any revision of this invoicing pursuant to the provisions of Article R. 211-8 ;
9° The indication, if applicable, of the fees or taxes relating to certain services such as landing, disembarkation or embarkation taxes in ports and airports, tourist taxes when they are not included in the price of the service or services provided;
10° The schedule and terms of payment of the price; the last payment made by the buyer may not be less than 30% of the price of the trip or stay and must be made when the documents enabling the trip or stay to be carried out are delivered;
11° The special conditions requested by the buyer and accepted by the seller;
12° The manner in which the buyer may lodge a complaint with the seller for non-performance or improper performance of the contract, which must be addressed as soon as possible, by any means making it possible to obtain an acknowledgement of receipt from the seller, and, where appropriate, notified in writing, to the tour operator and the service provider concerned;
13° The deadline for informing the buyer in the event of cancellation of the trip or stay by the seller in the event that the trip or stay is linked to a minimum number of participants, in accordance with the provisions of 7° of Article R. 211-4 ;
14° Cancellation conditions of a contractual nature;
15° The cancellation conditions provided for in Articles R. 211-9, R. 211-10 and R. 211-11;
16° Details concerning the risks covered and the amount of cover under the insurance contract covering the consequences of the seller’s professional civil liability;
17° Information concerning the insurance contract covering the consequences of certain cases of cancellation taken out by the buyer (policy number and name of the insurer) as well as information concerning the assistance contract covering certain specific risks, in particular repatriation costs in the event of accident or illness; in this case, the seller must provide the buyer with a document specifying at least the risks covered and the risks excluded;
18° The deadline for informing the seller in the event of a transfer of the contract by the buyer;
19° The commitment to provide the buyer, at least ten days before the scheduled departure date, with the following information:
(a) The name, address and telephone number of the local representative of the seller or, failing that, the names, addresses and telephone numbers of local bodies likely to assist the consumer in the event of difficulties or, failing that, the telephone number making it possible to establish urgent contact with the seller;
(b) For the travel and stay abroad of minors, a telephone number and an address to establish direct contact with the child or the person in charge of the child’s stay;
20° The clause of termination and refund without penalty of the sums paid by the buyer in the event of non-compliance with the information obligation provided for in 13° of Article R. 211-4;
21° The commitment to provide the buyer, in due time before the beginning of the trip or stay, with the departure and arrival times.

Article R.211-7 :
The buyer may assign his contract to an assignee who meets the same conditions as him to carry out the trip or stay, as long as this contract has not produced any effect.
Unless otherwise agreed in favour of the transferor, the transferor is required to inform the seller of his decision by any means necessary to obtain an acknowledgement of receipt at the latest seven days before the start of the journey. In the case of a cruise, this period is extended to fifteen days. This transfer is not subject, under any circumstances, to prior authorization by the seller.

Article R.211-8 :
Where the contract expressly provides for the possibility of revising the price, within the limits provided for in Article L. 211-12, it must specify the precise methods of calculating price changes, both upward and downward, and in particular the amount of transport costs and related taxes, the currency or currencies which may have an impact on the price of the trip or stay, the part of the price to which the change applies, the rate of the currency or currencies used as a reference when establishing the price indicated in the contract.

Article R.211-9 :
When, before the buyer’s departure, the seller is forced to make a modification to one of the essential elements of the contract such as a significant increase in the price and when he ignores the obligation to provide information mentioned in 13° of Article R. 211-4, the buyer may, without prejudice to any claims for compensation for any damage suffered, and after having been informed by the seller by any means enabling him to obtain an acknowledgement of receipt:
-either terminate his contract and obtain immediate reimbursement of the sums paid without penalty;
-either accept the modification or the alternative trip proposed by the seller; an amendment to the contract specifying the modifications made is then signed by the parties; any reduction in price is deducted from any amounts still due by the buyer and, if the payment already made by the latter exceeds the price of the modified service, the excess payment must be returned to him before the date of his departure.

Article R.211-10 :
In the case provided for in Article L. 211-14, when, before the buyer’s departure, the seller cancels the trip or stay, he must inform the buyer by any means allowing him to obtain an acknowledgement of receipt; the buyer, without prejudice to any claims for compensation for any damage suffered, obtains from the seller an immediate refund and without penalty of the sums paid; in this case, the buyer receives compensation at least equal to the penalty he would have incurred if the cancellation had occurred on that date.
The provisions of this article shall in no way prevent the conclusion of an amicable agreement aimed at the acceptance, by the buyer, of an alternative trip or stay proposed by the seller.

Article R.211-11 :
In the case provided for in Article L. 211-14, when, before the buyer’s departure, the seller cancels the trip or stay, he must inform the buyer by any means allowing him to obtain an acknowledgement of receipt; the buyer, without prejudice to any claims for compensation for any damage suffered, obtains from the seller an immediate refund and without penalty of the sums paid; in this case, the buyer receives compensation at least equal to the penalty he would have incurred if the cancellation had occurred on that date.
The provisions of this article shall in no way prevent the conclusion of an amicable agreement aimed at the acceptance, by the buyer, of an alternative trip or stay proposed by the seller.

Special conditions of sale

1/ Registration for our stays, our tailor-made trips, private or group guided tours.

Lotus 3T France offers tailor-made trips and private tours, accompanied or in groups, on its exclusive websites.

We offer stays, guided tours with fixed dates, standard programs whose prices may vary when confirming the quote according to the number of participants requested at least and the number of flights filled. The programmes are produced by Lotus 3t France on the destinations for which it is a specialist: Vietnam, Thailand, Cambodia, Laos and Myanmar (Burma).

The prices of travel offers produced by Lotus 3t France are calculated with prices negotiated with Lotus 3T France partner airlines in certain booking classes which may no longer be available at the time of booking and which may therefore require booking in a more expensive booking class and entail additional costs. These quotations are sent to you electronically and have a limited validity period, beyond which the various components, prices and programs cannot be maintained.
The sending of the registration form duly validated by you, will be accompanied by the payment of a deposit of 30% of the total amount of the estimate for any trip whose departure date is more than 35 days, or the totality for any departure date less than this deadline, and will validate your registration.
The deposit may in some cases be higher when airline tickets must be issued as soon as the reservation is confirmed. The customer will be informed immediately before acceptance of the amount due.
Lotus 3T France will confirm the availability of the requested or similar services as soon as possible. The deposit paid may only be refunded if it is impossible to provide the requested service or similar, to the exclusion of any other reason, reservation requests are only actually made upon receipt of the client’s financial commitment.

2/ Rates, payment and invoicing terms

2.1 Tarification

Upon confirmation of the registration form, the price is firm, definitive and in euros (except as otherwise provided in these GTC)
Only the services explicitly mentioned in the travel description are part of the package. In all cases, unless otherwise specified, are not included in the price: personal expenses (tips, telephone, various guarantees, etc.), vaccination, visa, optional excursions and in general any benefits not expressly included in the travel description, excess baggage, drinks during meals (including bottled water when the service provider does not have potable running water), fuel increases, as well as possible government taxes. The amount of these taxes may be increased or decreased without notice by the authorities concerned. The amount of these taxes may not be modified by Lotus 3T France less than 30 days before departure.

a) Special rules for changing tariffs

  • Some rates subject to special rules, such as single room surcharges and children’s discounts, are provided for information only. If a change should affect the amount of these rates, the customer will be informed before confirming his order.
  • In accordance with article L. 211-12 of the French Tourism Code, we reserve the right to modify our prices upwards or downwards to take into account significant variations between the day of registration and the day of departure:
    • Transport costs, including fuel costs
    • Fees and taxes relating to the services offered, such as landing, embarkation and disembarkation taxes in ports and airports
    • Variations in exchange rates applied to the trip or stay in question.

A price revision cannot take place less than 30 days before departure. In accordance with Decree R 211-8 of the French Tourism Code, changes in the cost of transport will be passed on pro rata to their share in the calculation of the amount of the price of the booked trip. Any refusal by the registered traveller(s) to pay this adjustment will be considered as a cancellation by the traveller(s) concerned, with application of the Lotus 3T France cancellation scale. (Art. 4 of the CPV)

2.2 Taxes

In addition to the airport and/or local taxes directly collected when ordering, additional local taxes may be imposed by the local authorities of certain countries and are to be paid locally in local currency or US dollars.

2.3 Payment terms and conditions

a. General rules and regulations

You can pay for your trip by credit card, cheque (exclusively more than 15 days from the departure date), transfer, mail or via our sites (secure payment). The balance of the CB payments will be automatically debited, without notice from us 35 days before the departure date. In accordance with article L.121-20-4 of the French Consumer Code, you do not benefit from a withdrawal period as soon as you order travel services via the travel sales websites.
A deposit of 30% of the trip price is received by Lotus 3T France more than 35 days before departure. However, in some cases (e.g. depending on the type of flight ticket and when it was issued) the amount of the deposit may be higher. In order to validate your registration, for any departure less than this deadline, the full payment is due upon registration.
For a trip more than 35 days before departure :

  • At least 30% deposit of the amount at the time of booking
  • The balance at the latest 35 days before the departure date
  • Application fees available to date

 

For any type of trip within 35 days of departure :

Payment of the full price of the trip at the time of booking (cheques are not accepted)

b. Exceptions related to certain destinations :

On some destinations (India for example) and/or promotional or special products, hotels / tour operators partners and/or local service providers may charge us 100% cancellation fees upon firm booking. We will then be obliged to demand the immediate payment of 100% of the travel price regardless of the departure date.

3/ Information for the traveller

3.1 Administrative and health formalities

You must check before your registration that each traveller, according to his or her personal situation, is in possession of a passport and/or other document (national identity card, visa, family record book, authorization to leave the country…) valid and in compliance with the requirements for transit and/or entry into the country(ies) of stay.

Lotus 3T France consultants will provide you with this information for all French nationals. It is the responsibility of nationals of other countries to check with the competent authorities before travelling on the administrative and health formalities required.

Clients of French nationality must check that the documents, particularly administrative and health documents, required for the completion of their trip, are in accordance with the information provided by us. We therefore strongly recommend that our clients verify all this information with the relevant authorities. Lotus 3T France cannot in any way be held responsible for the consequences of the customer’s failure to comply with police, customs or health regulations, before or during their trip.

A customer who could not board a flight because he or she did not present the required documents would not be entitled to any reimbursement whatsoever.

Visas :

Vietnam : – Visa to be obtained at Vietnamese Embassies or Consulates abroad is done by clients.

                – Visa on arrival only at air borders (Hanoi, Ho Chi Minh City and Da Nang): Lotus 3T France offers its customers a visa approval service. Customers will be asked to provide passport information no later than 3 weeks before departure.

Cambodia : – Visa to be obtained at Cambodian Embassies or Consulates abroad is done by clients.

                      – Visa on arrival will be issued at the borders. There are no formalities to do before departure.

Laos:   – Visa to be obtained at Laos Embassies or Consulates abroad is done by clients.

             – Visa on arrival will be issued at the borders. There are no formalities to do before departure.

Thailand :  – For stays or trips of less than 29 days in Thailand, clients are exempt from the visa requirement. Beyond this period, the Visa is mandatory and is done at the Embassies or Consulates of Thailand abroad by clients.

Myanmar:  – Visa to be obtained at Myanmar Embassies or Consulates abroad is done by clients.

                    – Visa on arrival will be made online by customers on the Myanmar Government’s website : http://evisa.moip.gov.mm/

3.2 Safety and health risks

Lotus 3T France consultants inform you about the health and safety conditions in your destination countries. We also invite you to read the corresponding country sheets published by the French Ministry of Foreign and European Affairs (MAEE). You can access it via the website www.diplomatie.gouv.fr, under “Advice for Travellers”.
Attention: as the information may change up to the date of your departure, it is advisable to consult it regularly.

Concerning health risks: Lotus 3T France recommends that you regularly review the information provided by the competent authorities on the health risks of the country/countries of your trip and follow the recommendations of the Ministry of Health website (http://www.sante.gouv.fr/) or the World Health Organization WHO website (http://www.who.int/fr/)

4/ Conditions of modification and cancellation by the customer after validation of the registration form.

4.1 Changes made by the customer before departure

Change fees :

More than 30 days before departure: 35 € per person

  • Between 30 and 21 days before departure: 50 € per person
  • Between 20 and 8 days before departure: 80 € per person

NB: may be considered as cancellations (see cancellation conditions below), some requests for written changes as follows :

  • A change of departure/destination city
  • A hotel modification
  • A change in departure and arrival dates
  • Cancellation of services

Exception : any request to change the names of participants due to a spelling error or change in civility will only incur any costs requested by the provider. Please note that in the case of scheduled flights, these costs may amount to the amount of the purchase of the round trip ticket.

4.2 Cancellation conditions due to the customer before departure

Cancellation fees are due as soon as the reservation is final.
Any request for cancellation must be addressed in writing to Lotus 3T France (LRAR or email). The date of the postmark or the date of receipt of the email will be the date used for cancellation.
It will involve the application of at least the following costs (subject to specific mentions in the description of the chosen product) :

  • a. For terrestrial services in the country (car, guide, hotel, driver, restaurants, activities, visits etc.)

–  More than 35 days before departure: 10% of the total amount per person (except as provided for in the special conditions of the 4-5 star hotel sector. In this case, the amount of the cancellation fee is indicated in the sales contract)
– 35 to 21 days before departure: 25% of the total amount 10% of the total amount per person (except as provided for in the special conditions of the 4-5 star hotel industry. In this case, the amount of the cancellation fee is indicated in the sales contract)
– 20 to 15 days before departure: 50% of the total amount
– 14 to 8 days before departure: 75% of the total amount
– 8 to 3 days before departure: 90% of the total amount
– less than three days before departure: 100% of the total amount.

  • b. Air services. Cancellation fees are indicated in the Registration Form and depend on the type of ticket. In the event of a flight that cannot be modified and is not refundable, the cancellation fee is 100% of the price of the scheduled flight excluding insurance

4.3 Additional details

Any trip interrupted, shortened or any service not consumed by the customer will not entitle the customer to any reimbursement, in particular all seats on both the outward and return flights. If the client has taken out optional insurance covering in particular the interruption of the stay, he must comply with the cancellation terms and conditions set out in the general and specific conditions of the insurance policy. Lotus 3T France undertakes to the customer only for the services sold.

Lotus 3T France cannot be held liable for:

  • Any service subscribed by the customer outside the stay invoiced by Lotus 3T France
  • Any modification of the stay at the initiative of the client on site

In the event of cancellation of the trip, insurance, possible application fees and visas are never refundable. Lotus 3T France informs the customer of the existence of insurance contracts covering the consequences of cancellation, see article 7 of these conditions.
In the event of non-arrival on a scheduled flight, Lotus 3T France will only be able to maintain the other services if the customer expressly requests it in writing within 24 hours of the initial scheduled departure. However, it is still possible that the airline may cancel the Return ticket. In this case, the customer will have the possibility to buy back tickets at his own expense, subject to availability.
Lotus 3T France will then do its utmost to guarantee the other services. The costs incurred by the purchase of a new air ticket remain the responsibility of the customer. No refund may be granted for services not consumed due to the client’s failure to show up at the time of departure initially planned. (hotel nights, meals.). If a late arrival should result in additional costs for Lotus 3T France (such as for example the organization of a new transfer) these costs will remain the responsibility of the customer.
If the cancellation of the stay of one of the persons listed on the order form results in the reservation of a single room, instead of a double room, the supplement must be paid before departure. For the tailor-made trip, apart from the single room supplement caused by the cancellation of a person from the group, the price of the trip per person will be revised according to the number of departures.

5/ Transport

5.1 Aerial

a. General information : Lotus 3T France communicates the name and schedules of the air carrier as soon as it registers and undertakes to inform its customers immediately in the event of any change in the flight or air carrier. In accordance with European regulations, Lotus 3T France only uses the services of airlines authorised by the DGAC. Air transport is subject to operational and safety requirements that may cause delays beyond the control of Lotus 3T France. We advise you to plan sufficient connection times for any connections you may have, and to avoid any commitment on the same day and the day after your round trip, especially when it comes to charter flights.

b. Schedule changes / carrier liability : For the execution of the trips, Lotus 3T France uses different carriers who keep their own responsibilities towards the travellers. The carrier’s liability is limited by the terms and conditions set out in the contract of carriage on the passenger’s ticket, and in particular by the provisions resulting from the Montreal Convention of 28 May 1999.
Lotus 3T France is not liable for any damage or accident that may occur to passengers, their animals and checked baggage during the duration of the flight or during boarding, disembarkation or during the period during which the carrier was in charge of the checked baggage

c. Pregnant women : Lotus 3T France informs the customer that companies sometimes refuse to board a pregnant woman when they consider that due to the end of pregnancy, a risk of premature delivery during transport is possible.

d. Minors : Children under 2 years of age do not have a seat on the plane. Unaccompanied children under 18 years of age may be refused.

e. Luggage : Baggage is generally carried free of charge up to a maximum of 20 to 30 kg per person occupying a seat, which excludes children under 2 years of age.
As this allowance is reduced on some airlines, the maximum baggage weight may differ.  Surpluses are taxed at the passenger’s expense.
Any lost or damaged checked baggage must be reported by the passenger to the airline and possibly to the insurance company if additional baggage insurance has been taken out.

5.2 Reconfirmations of returns

Lotus 3T France informs its customers that they are required to reconfirm their reservation with the airline for each flight, at the latest 3 days before the scheduled date, failing which it will not be maintained. For package tours, this formality is usually completed by the local correspondent. However, the client may be asked to do this himself.

6/ Terrestrial services and accommodation

6.1 Conditions of the offer

It is the rule in international hotels to take possession of the room from 2 p.m. and to vacate it before 12 noon, regardless of the time of the return flight. Under no circumstances may Lotus 3T France derogate from this rule. Any room taken before 2pm (unless successfully negotiated between Lotus 3T France and the hotelier) or returned after 12pm is considered as a consumed night. Prices are calculated on a number of nights and not days. The first and last day are devoted to transport.

6.2 Classification and services of the hotel establishment

The number of stars attributed to the hotel establishment in the description corresponds to a classification established with reference to local standards in the host country and which may therefore differ from French and European standards. Lotus 3T France strives to inform you as precisely as possible about the conditions of your hosting. The assessments we make of our descriptions are based in particular on our knowledge of the establishments and the assessments sent to us by our customers and local partners.

6.3 Modification of hotels, tours, hotel dislocation

In the following cases – force majeure, security reasons, acts of a third party – Lotus 3T France or its supplier may be obliged to change the hotels or services mentioned, without this measure constituting a modification of an essential element of the trip. As far as possible, the customer will be notified in advance and Lotus 3T France suppliers will offer him a service in the same category as the one initially proposed. Similarly, in some countries, the tours may be modified in meaning, but all the visits and stops planned will be respected. Civil and religious holidays, strikes and demonstrations in the countries visited are likely to lead to changes in the visits or excursions, for which the organiser cannot be held responsible.

6.4 Types of rooms

Single rooms, which are limited in number, may frequently be subject to an additional charge. Double rooms are available, either with two beds or with a double bed. Triple and quadruple rooms are often double rooms with extra beds.

6.5 The activities proposed during the stay

Some proposed activities may present risks, especially for young children. It may happen that some activities indicated in the description are deleted by our local service provider. Lotus 3T France cannot be held liable if these activities are cancelled in the event of force majeure, the unforeseeable and insurmountable fact of a third party outside the service or the fault of the customer.

6.6 Babies

Lotus 3T France invites parents of babies to take with them the food adapted to their child that they will not always find on the spot. A contribution to be paid on site may be required, for example to heat dishes or bottles. This participation will then be indicated in the sheets produced. Lotus 3T France does not recommend the purchase of an accompanied tour or a self-guided tour with a child under two years of age.

6.7 Photos and illustrations

Lotus 3T France strives to illustrate its proposals with photos or illustrations that give a realistic overview of the services offered. However, it is specified that the photos and illustrations in the description are simply illustrative of the services. They are only binding on Lotus 3T France insofar as they indicate the category or degree of standing of these services. In any case, the photographs of rooms are not contractual.

7/ Assurances

Lotus 3T France strongly recommends that its customers take out insurance covering specific travel risks such as diseases, accidents, natural disasters, medical repatriation, etc.
We offer a range adapted to these needs and we invite you to read the terms, prices and exclusions by consulting the descriptions below; our advisors are at your disposal for any additional information.
In the event of a claim, before or during the trip, it is your responsibility to contact us in advance, then to open without delay (please refer to the insurance contract) a file with the insurance company in order to initiate the appropriate procedure.

8/ Responsibility

Definition of force majeure. Force majeure is defined as any event external to the parties that is both unforeseeable and irresistible and prevents the client and/or the agency/its suppliers from performing all or part of the obligations provided for in the contract (riots, wars, political unrest, health situation, pollution, natural and/or climatic events) or technical incidents outside Lotus 3T France  (strikes by air sector personnel, airspace congestion, delays in means of transport, loss or theft of luggage or other effects)

Before the departure. In the event of cancellations imposed by circumstances of force majeure and/or motivated by the protection of the safety of our customers and/or at the request of an administrative authority, customers will not be entitled to any compensation. In particular, we may, in compliance with the provisions of the Tourism Code, propose to our customers the modification of dates, schedules and itineraries.

After the departure. In the event of force majeure, the parties’ obligations shall be suspended. The delay or delays and any resulting changes to the itinerary shall not result in any compensation for any reason whatsoever, in particular as a result of a change in the duration of the programme initially planned or a delay in a connection. Any additional costs related to a disruption (tax, hotel, change of means of transport, parking,…) will remain the responsibility of the customer.

9/ Complaints and claims

We recommend that you report any problems related to non-performance or improper performance of services on site during your stay as soon as possible to the local receptionist. For a quick processing of your file, any complaint must be sent to Lotus 3T France by registered letter within 30 days following the return of the trip. These special conditions are subject to French law.

10/ Information Technology and Liberties

In accordance with Law No. 78-17 of 6 January 1978 on data processing, files and liberties, customers are informed that their order is subject to computerised nominative processing. The right of access and rectification guaranteed by law is exercised by Lotus 3T France at its headquarters.
Lotus 3T France informs you that the conversation with its specialized advisers can be listened to or recorded using a system declared to the National Commission on Information Technology and Freedom, and this for the sole purpose of ensuring a quality service. The retention period of the recordings 
may not exceed one month.

11/ Revision of the terms and conditions of sale

The version of the applicable Terms and Conditions of Sale is the one in force on the day of booking. Lotus 3T France reserves the right to modify or update its terms and conditions of sale at any time and without notice (however, the conditions of sale do not have retroactive effect)
